Terms of service
The terms that apply when you use this website.
1. About these terms
- 1.1 These terms of service (the “Terms”) apply to your use of the website at theomega.ai (the “Website”), which is operated by Omega AI (“we”, “us”, “our”). By accessing or using the Website you accept them. If you do not accept them, please do not use the Website.
- 1.2 Our registered company name, the trade mark attribution for it, and our registered office are shown at the foot of every page of the Website, including this one.
- 1.3 We may change these Terms. The version published on this page is the version that applies, so check it when it matters to you. If you continue to use the Website after a change, you accept the updated Terms.
- 1.4 If a court or regulator finds any part of these Terms unenforceable, that part is severed and the rest continues to apply.
- 1.5 A delay or failure by us to enforce any part of these Terms is not a waiver of it.
2. What these terms cover
- 2.1 These Terms govern your use of the Website and nothing else. The Website is an information site: it describes who we are, what we are building, and how to contact us.
- 2.2 Other than these Terms, nothing on the Website is an offer to sell, a contract, an inducement to invest, or financial, legal or technical advice. Any service we agree to provide you would be governed by a separate written agreement signed by both of us, and these Terms would not form part of it.
- 2.3 The Website describes work in progress as well as work that is complete. Where it describes capability we are building, that description is not a representation that the capability exists today, nor a commitment to deliver it, nor a commitment to any date.
- 2.4 Information on the Website is general in nature and may be incomplete or out of date. You should not rely on it as the sole basis for a decision. If a point matters to you, ask us.
3. Who may use the Website
- 3.1 You may use the Website only if you are at least 18 years of age and able to form a binding contract with us.
- 3.2 If you use the Website on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf, and “you” in these Terms means that organisation as well as you.
- 3.3 You are responsible for complying with the laws that apply to you. The Website is operated from Australia and we make no representation that it is appropriate or available for use in any other place.
4. Acceptable use
- 4.1 You may read the Website, link to it, and print or save pages for your own reference.
- 4.2 You must not:
- use the Website unlawfully, or for any unlawful or fraudulent purpose;
- attempt to gain unauthorised access to the Website, or to any system or network behind it;
- probe, scan, load-test or otherwise test the security of the Website, except as clause 4.4 permits;
- interfere with the Website’s operation, or introduce any malicious or harmful code to it;
- scrape, harvest, mirror or bulk-copy the Website or its content, whether by automated means or otherwise;
- submit false, misleading or impersonating information through the contact form, or another person’s details without their authority; or
- use the contact form to send unsolicited commercial messages, or to send anything unlawful, defamatory, offensive or infringing.
- 4.3 We may restrict, suspend or withdraw your access to the Website at any time and without notice, where we reasonably believe you have breached clause 4.2 or where we need to protect the Website or its other users.
- 4.4 We welcome reports of genuine security problems with the Website. The exception in clause 4.2 covers probing, scanning and load-testing only, and only where you stay within this clause. Every other prohibition in clause 4.2 continues to apply, including those on unauthorised access, on interference, and on false or impersonating submissions through the contact form.
- You may send ordinary application requests to theomega.ai and www.theomega.ai, the public marketing site, and to the contact-form endpoint those pages post to.
- You must not target the infrastructure underneath them, including our hosting, cloud and email providers, or any customer system. Sending a request to the application endpoint is permitted; testing the provider services that host or deliver it is not, and we cannot authorise testing against systems we do not control.
- You must not submit test records through the contact form. A submission is written to our production records and sends email, including to the address you supply.
- You must not run denial-of-service or volumetric testing against the Website.
- The contact-form endpoint URL is visible in the Website’s JavaScript. That is deliberate and is not a vulnerability: pinning it at build time means redirecting it takes a reviewed code change rather than a setting, and no credential is published with it.
- Report what you find to hello@theomega.ai, with the affected page or endpoint, the steps you took, and what you observed. We will acknowledge your report and tell you whether it is in scope. Reports consisting only of scanner output, with no demonstrated impact, are not actioned.
5. Intellectual property
- 5.1 The Website, and all content, text, images, layout, design and code in it, is owned by us or by our licensors, and is protected by Australian and international copyright and trade mark law. Clauses 4.1 and 5.2 are the only licences we grant you over it.
- 5.2 You may quote a short extract from the Website if you attribute it to us and link to the page it came from. Any other copying, adaptation, republication, framing or commercial use requires our written permission.
- 5.3 Our name, logo and brand marks are ours. Nothing on the Website or in these Terms grants you any licence to use them. The attribution at the foot of each page names the owner of the mark.
- 5.4 Typefaces, imagery and other third-party assets used in the Website are licensed to us for use in it. Those licences do not extend to you, so clause 5.2 does not permit you to extract and reuse them.
- 5.5 Third-party names and marks that appear on the Website remain the property of their owners, and their appearance is not a claim of ownership by us.
6. Information you send us
- 6.1 Our privacy policy sets out what personal information we collect, why we collect it, where it is stored, what leaves Australia, and how to ask us for access, correction or deletion. It governs that information and these Terms do not change it.
- 6.2 You are responsible for what you submit. Please do not send us confidential information, personal information about other people, or anything you are not entitled to disclose.
- 6.3 Unless we have agreed otherwise with you in writing, we do not treat what you submit through the Website as confidential, and no obligation of confidence arises from your sending it. We use it to respond to your enquiry and to assess whether we can help, as described in the privacy policy.
- 6.4 If you send us an idea, suggestion or feedback about the Website, you agree we may use it without obligation or payment to you. This does not affect any intellectual property you already own, and it does not apply to information covered by a separate written agreement between us.
7. Links to other sites
- 7.1 The Website links to a small number of sites we do not control. We are not responsible for their content, their accuracy, their availability, or how they handle your information.
- 7.2 A link is not an endorsement. When you follow one you leave the Website, and that site’s own terms and privacy policy apply to you from that point.
8. Availability of the Website
- 8.1 We aim to keep the Website available, but we do not promise that it will be uninterrupted, timely, error free, or free of harmful components.
- 8.2 We may change, suspend or withdraw any part of the Website, or the whole of it, at any time and without notice.
- 8.3 Except as clause 9.1 provides, the Website is made available on an “as is” and “as available” basis.
9. Liability
- 9.1 Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law, where it cannot lawfully be excluded, restricted or modified. The rest of this clause 9 applies only to the extent the law allows.
- 9.2 Subject to clause 9.1, we are not liable to you for any loss or damage arising out of your use of, or your reliance on, the Website, including indirect, special or consequential loss, loss of profit or revenue, loss of opportunity, or loss or corruption of data.
- 9.3 Subject to clause 9.1, where our liability may be limited but not excluded, our liability to you is limited to resupplying the relevant information or paying the cost of having it resupplied.
- 9.4 You are liable to us for loss we suffer as a result of your breach of clause 4.2.
10. Governing law
- 10.1 These Terms are governed by the laws of New South Wales, Australia.
- 10.2 You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and of the courts able to hear appeals from them.
11. Contact us
- 11.1 For any question about these Terms, email hello@theomega.ai.
- 11.2 Written notice may be sent to our registered office at Suite 2/6 McIntosh Street, Chatswood NSW 2067, Australia.
